Offer Terms
1. GENERAL PROVISIONS
1.1. The following text is an Agreement between the online store fedox.com.ua, hereinafter referred to as the "Seller – "FOP Vornikov Fedir Mykolayovych" (identification code 3540804217), acts in accordance with the current legislation of Ukraine", and the user of the online store services, regardless of their status (individual, legal entity, or individual entrepreneur), hereinafter referred to as the "Buyer."
1.2. This Agreement defines the terms of purchase of flowers and gifts, hereinafter referred to as the "Product," by the Buyer through the Seller's online store.
1.3. The Agreement is public in accordance with Articles 633 and 641 of the Civil Code of Ukraine and is equivalent to an "oral agreement," having full legal force.
1.4. According to Article 642 of the Civil Code of Ukraine, full and unconditional acceptance of the terms of this offer agreement, confirming the conclusion of the Agreement under the proposed terms, is the Buyer's payment for the ordered product on the online store's website (or by another method).
1.5. In the offer, unless the context requires otherwise, the following terms have the following meanings:
"Online Store" - the Seller's website created for the conclusion of retail and wholesale purchase-sale Agreements after the Buyer familiarizes themselves with the offered Product through photographs remotely.
"Seller" - an organization, regardless of its legal form, and/or an individual entrepreneur engaged in the sale of products.
"Product" - the goods offered for sale and listed on the website fedox.com.ua.
"Buyer" - an individual and/or legal entity that places an order on the website fedox.com.ua.
"Recipient" - an individual and/or legal entity specified by the Buyer, who is to receive the ordered Product.
"Acceptance" - full and unconditional acceptance of the Agreement's terms by the Buyer.
"Order" - specific items from the range of Products selected by the Buyer when placing an order on the website.
2. SUBJECT OF THE AGREEMENT
2.1. The Seller sells and delivers the Product according to the current price list published on the website fedox.com.ua, and the Buyer pays for and accepts the Product in accordance with the terms of this Agreement.
3. ORDER PLACEMENT PROCEDURE
3.1. Order Formation.
3.1.1. Orders are accepted through the website fedox.com.ua during the Seller's working hours.
3.1.2. The cost of all types of delivery is specified in the "Delivery" section on the Seller's website.
3.1.3. The Seller does not provide services for purchasing and delivering goods acquired from third parties on behalf of the Buyer.
3.1.4. When placing an order, the Buyer must provide accurate Recipient details. Incorrect information provided by the Buyer may prevent order fulfillment within the specified time. In this case, delivery is postponed until the correct details of the Recipient are clarified, but no more than 12 hours from the moment of order payment.
3.2. Order Payment Procedure.
3.2.1. Payment for the order signifies the Buyer's agreement to enter into this Agreement with the Seller.
3.2.2. The Buyer pays for the order under the Agreement by transferring funds to the Seller’s bank account. The payment date is considered the day the funds are credited to the Seller’s account.
3.2.3. Prices for any Product positions listed on the website fedox.com.ua are valid at the time of ordering.
3.2.4. The Buyer has the right to confirm or cancel the order before payment.
3.2.5. Orders are accepted for fulfillment only after the funds are credited to the Seller's account, except in cases where "cash on delivery" payment is chosen.
3.2.6. The Buyer pays additional fees for payment system services and terminals.
4. ORDER EXECUTION TIME
4.1. The order execution time depends on the Recipient's location. It also depends on the order complexity, product availability, and unforeseen events beyond the Seller’s control (accidents, weather conditions, traffic, etc.).
4.2. The order is considered fulfilled at the moment it is handed over to the Recipient/Buyer and/or their authorized representatives.
4.3. The Agreement between the Seller and the Buyer remains in effect from the moment of its conclusion until the order is delivered to the Recipient/Buyer or their authorized representatives.
10. LIABILITY
10.2. The Recipient or the person who accepted the goods in the absence of the Recipient assumes all risks associated with the loss or damage of the goods from the moment of acceptance.
10.3. The Seller has the right to transfer its rights and obligations for order fulfillment to third parties without releasing itself from responsibility.
10.4. The Seller is not responsible for improper use or storage of goods by the Buyer ordered on the website fedox.com.ua.
10.5. The liability of the Parties in other cases is determined in accordance with the legislation of Ukraine.
10.6. The Parties agree that any disputes unresolved through negotiations shall be resolved in accordance with the current legislation of Ukraine.
